SUMMARY:Introducing the Labor Rights Investor Network: A Forum for Investor Education and Exchange on Workplace Rights
DESCRIPTION:Investors have three reasons to advance their stewardship of labour rights. First\, labour rights are human rights and investors have responsibilities to respect these rights in their investment and stewardship decisions. Second\, respect for labour rights enables investors to mitigate systemic and company-specific risks. And third\, freedom of association and collective bargaining\, along with other worker rights such as the right to a safe and healthy workplace\, can improve corporate performance. \nThe Labour Rights Investors Network will provide investors with the actionable information they need to engage on labour issues\, uphold their responsibilities to respect human rights\, mitigate workplace risks\, and drive stronger returns. An initiative of the Global Unions’ Committee on Workers’ Capital (CWC)\, the Network will offer events and resources\, including regular opportunities for education and exchange on issues such as identifying labour risks\, the impact of different legal contexts\, and how stewardship can improve transparency and performance on freedom of association and collective bargaining. The Network will provide written resources\, bring workers to share their experiences\, and connect investors to experts in such areas as international labour standards\, country-specific labour laws\, and workplace health and safety. \nOur first webinar will provide a selection of the types of content the Network will offer. Given that they are often the among the largest shareholders in companies\, global asset managers can carry significant influence when it comes to changing corporate behaviour on fundamental labour rights. Over the 2023 proxy season\, the Secretariat of the Global Unions’ Committee for Workers’ Capital (CWC) encouraged global asset managers to support resolutions that were backed by CWC participants at publicly-listed companies such as Amazon.com\, Starbucks\, Netflix\, POSCO Holdings\, and Kingspan Group. \nIn this webinar\, the CWC will release its latest report\, Voting for Labour Rights: How the World’s Largest Asset Managers Measured Up in Proxy Season 2023\, which reviews how global asset managers voted on CWC-backed resolutions. DESCRIPTION:With unionization efforts at US companies continuing into 2024\, workplace rights have become an increasingly important topic of investor engagement across industries.\n\nInvestors expect portfolio companies to establish and disclose effective policies to respect fundamental labour rights. Recently\, airline industry leaders\, including Southwest Airlines\, United Airlines\, American Airlines and JetBlue\, have taken steps to strengthen their policies and practices in this regard. In contrast to its peers’ proactive approach to labor rights\, SkyWest Inc. is alleged to have retaliated against employees seeking union representation\, and to have formed an illegal company union. Amalgamated Bank has responded by filing a shareholder resolution that calls on the company to adopt a non-interference policy upholding its employees’ rights to freedom of association and collective bargaining.\n\nThis event\, hosted by SOC Investment Group\, will focus on SkyWest Inc.’s anti-union practices and the investor risk that results from a lack of clear labour rights policies. Join us on June 4th for a webinar discussion where investors will hear directly from a Tesla worker\, a representative from the Swedish trade union (IF Metall)\, and concerned Tesla shareholders. The panel will discuss the associated risks of the automaker’s anti-union practices and a shareholder resolution calling for a Non-interference and Collective Bargaining Policy at Tesla. \nWhile Tesla has recently modified its Global Human Rights Policy\, the company continues to be entangled with credible allegations of violating its workers’ rights to freedom of association and collective bargaining. In Sweden\, Tesla is facing a prolonged strike and solidarity actions across northern Europe stemming from the company’s refusal to negotiate a collective agreement. Meanwhile in Germany – the location of its first European Gigafactory employing more than 11\,000 workers – the company faces allegations that it is refusing to bargain with a union. In the United States\, the National Labor Relations Board (NLRB) has issued complaints against Tesla citing violations of its workers’ labour rights. Through its Firestone Liberia Inc. subsidiary\, Bridgestone operates the world’s largest rubber plantation in Liberia\, where it is the country’s biggest private employer. \nThe Firestone Agricultural Workers Union of Liberia (FAWUL) is seeking to improve the working conditions and protect the rights of thousands of contract workers at the plantation. This webinar will provide investors with first-hand information on working conditions and labour rights risks at the Firestone Liberia Inc. rubber plantation in Liberia. \nBackground \nIn 2007\, workers at the Firestone Liberia plantation successfully formed a trade union\, the Firestone Agricultural Workers Union of Liberia (FAWUL). The union achieved a first collective bargaining agreement in 2008\,[1] and has re-negotiated successive collective bargaining agreements since then\, gradually improving wages\, working conditions and living conditions for plantation workers and their families. However\, in 2019\, Firestone management took the dramatic step of terminating the employment of more than 2\,000 FAWUL-represented employees and required them to sign employment contracts with one of twelve authorized third-party labour contracting agencies in order to keep working.[2] \nContract workers on the Firestone Liberia’s plantation voted to form a union on August 31\, 2024\, hoping to become Firestone employees represented by FAWUL and address concerns regarding their working conditions. Yet the majority of the 150 million people working via online platforms are treated as self-employed or classified as independent contractors\, which restricts their ability to join a union and excludes them from minimum-wage guarantees\, paid leave and other social protections in many jurisdictions. \nWhen platform business models are misaligned with international labour standards\, investors may face material operational\, legal\, regulatory and reputational risks that pose distinct stewardship challenges. \nThis session will explain why labour rights in the platform economy matter for PRI signatories and how they may approach stewardship.
